2. Services

NetworkDefender Security provides managed cybersecurity services to small businesses, primarily in Wisconsin. The specific terms, scope, and pricing of any service engagement are governed by a separate written agreement between NetworkDefender Security and the client. Nothing on this Site constitutes a binding service agreement.

3. Accuracy of Information; No Professional Advice

We strive to keep the information on this Site accurate and up to date. However, we make no warranties or representations as to the accuracy, completeness, or timeliness of any content. Cybersecurity threats and best practices evolve rapidly.

Content published on this Site is for general informational purposes only and does not constitute professional cybersecurity advice. It should not be relied upon as a substitute for a formal engagement with a qualified security professional. NetworkDefender Security assumes no responsibility for actions taken based solely on information read on this Site without a separate written service agreement in place.

4. Intellectual Property

All content on this Site, including text, graphics, and logos, is the property of NetworkDefender Security and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission. Intellectual property rights in deliverables produced under a client service agreement are governed solely by that agreement, not these Terms.

The Site may contain links to third-party websites (such as cited research or statistics). These links are provided for your convenience only. We do not endorse or assume responsibility for the content, privacy practices, or accuracy of any third-party sites.

6. Limitation of Liability

NetworkDefender Security shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this Site or reliance on any content herein. Our total liability for any claim arising solely from your use of this Site shall not exceed the total amount paid by you to NetworkDefender Security in the twelve (12) months preceding the claim.

7. Disclaimer of Warranties

This Site is provided "as is" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Contact Form Submissions and Cookies

The handling of information submitted through our contact form, and our use of cookies and similar tracking technologies (including Google Analytics and Google Ads), is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Dispute Resolution and Governing Law

These Terms of Service are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions.

Before initiating any legal proceeding, the parties agree to attempt to resolve any dispute informally in good faith for a period of at least 30 days following written notice of the dispute to the other party. If informal resolution is unsuccessful, any dispute shall be resolved in the state or federal courts located in Dane County, Wisconsin, and each party consents to personal jurisdiction in those courts.

10. Changes to These Terms

We reserve the right to update these Terms of Service at any time. All changes will be posted on this page with an updated "Last updated" date. For material changes, we will provide at least 14 days' notice before the changes take effect, either by posting a prominent notice on this Site or by emailing contacts who have submitted inquiries through our contact form. Continued use of the Site after changes take effect constitutes acceptance of the revised terms.

11. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
